The first sale of real estate property with registration of ownership transfer and encumbrances
Attention! The text of the contract for the first and subsequent sales of FREO (future real estate objects, in particular, future apartments) must contain ALL ESSENTIAL CONDITIONS stipulated by Article 13 of the Law of Ukraine “On Guaranteeing Property Rights to Real Estate Objects to be Constructed in the Future” No. 2518-IX dated 08/15/2022. In this case:
- the construction permit must be valid and up-to-date (verified by a notary according to the Unified State Electronic System in the Field of Construction (USESFC))
- the unfinished construction object, of which the FREO is a part, has NOT yet been put into operation (verified by a notary according to the USESFC data)
Notaries also continue to notarize and register in the USESFC new completed real estate, constructed on the basis of a Permit issued before October 10, 2022, in particular, constructed in accordance with the Law of Ukraine “On Financial and Credit Mechanisms and Property Management in Housing Construction and Real Estate Transactions”, taking into account the Law of Ukraine “On Regulation of Construction Activities”, the Law of Ukraine “On Joint Investment Institutions”.
